Reservation
The bankruptcy estate transfers all property in its existing condition. It is the buyer's responsibility to carry out the necessary inspection of the property to determine, for example, the scope of the property and to detect any defects and shortcomings. The bankruptcy estate does not provide any guarantees regarding the accuracy or completeness of the information provided in this tender document or otherwise.
The bankruptcy estate makes no guarantees regarding a buyer's ability to use or dispose of intellectual property rights. The use of transferred intellectual property rights is at the buyer's risk. The same applies to the customer database and marketing channels.
The transfer of property subject to agreements such as rental, leasing, or installment agreements requires the approval of the counterpart in each respective agreement. The same applies to the lease agreement for the warehouse and store premises.
Conducting the bidding process
Bids are primarily accepted for the entire business and secondarily for parts of the business and its assets.
Written bids, excluding VAT, for the business or parts of the business/assets must be submitted to the bankruptcy estate at the address alexandra.jaktelius.ferm@titovlaw.se no later than October 11, 2024, at 12:00.
The highest bid will be communicated to other bidders, who will then have the opportunity to increase their bids within a shorter time frame determined by the bankruptcy estate. However, the bankruptcy estate will not disclose the identities of the bidders.
The right to freely evaluate received bids is reserved, as well as the right to sell the entire or part of the business during the bidding process and the right to extend the bidding period.
